Agreement to Terms

These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Trivion Developments ("Company", "we", "us", or "our"), concerning your access to and use of our website, services, and any related applications.

By accessing our website at www.triviondevelopments.com or engaging our construction and development services, you agree that you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these terms, then you are expressly prohibited from using our services and you must discontinue use immediately.

These terms may be supplemented by additional terms and conditions, policies, or guidelines that apply to specific services. In case of conflict, such additional terms shall control.

Our Services

Trivion Developments provides comprehensive construction, architectural design, interior design, and real estate development services in Pakistan. Our services include but are not limited to:

Residential and commercial construction
Architectural design and planning
Interior design and decoration
Project management and consultation
Renovation and remodeling services
Real estate development
Structural engineering
Landscape design and execution

Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice. We may also refuse service to anyone for any reason at any time. Pricing and service offerings are subject to change without prior notice.

User Obligations & Responsibilities

By using our services, you represent and warrant that:

Accurate Information

All information you provide is accurate, current, and complete

Legal Capacity

You have the legal capacity to enter into binding contracts

Compliance

You will comply with all applicable local, state, and national laws

Property Rights

You have the legal right to authorize work on any property

Payment Obligations

You will fulfill all payment obligations as agreed

Site Access

You will provide safe and timely access to work sites

Permits & Approvals

You will obtain necessary permits and approvals (unless otherwise agreed)

Communication

You will maintain open communication and respond to inquiries promptly

Payment Terms & Conditions

Quotations & Estimates

All quotations and estimates are valid for 30 days from the date of issue. Prices are subject to change based on material costs, labor rates, and project scope modifications. Final pricing will be confirmed in the signed contract.

Payment Schedule

Unless otherwise specified in your project contract, our standard payment terms are:

  • Initial Deposit: 30% upon contract signing
  • Progress Payments: 40% at specified milestones
  • Final Payment: 30% upon project completion and approval

Late Payment Policy

Payments are due within 7 days of invoice date. Late payments may incur a service charge of 2% per month. We reserve the right to suspend work on projects with overdue payments exceeding 15 days.

Accepted Payment Methods

We accept bank transfers, cheques, and cash payments. All payments should be made to Trivion Developments. Payment receipts will be provided for all transactions.

Project Timeline & Delays

We strive to complete all projects within the agreed timeline. However, project timelines are estimates and may be affected by factors beyond our control, including but not limited to:

Weather conditions and natural disasters
Material availability and supply chain issues
Regulatory approvals and permit delays
Client-requested changes or modifications
Unforeseen site conditions
Labor availability and strikes
Third-party contractor delays
Force majeure events

In case of delays, we will notify you promptly and work diligently to minimize impact. Timeline extensions due to the above factors will not constitute a breach of contract.

Intellectual Property Rights

All content on our website, including but not limited to text, graphics, logos, images, designs, photographs, and software, is the exclusive property of Trivion Developments and is protected by Pakistani and international intellectual property laws.

Design Rights

All architectural designs, plans, and drawings created by Trivion Developments remain our intellectual property until full payment is received. Upon full payment, you receive a license to use the designs for the specific project only.

Usage Restrictions

You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of our content without our express written permission. Unauthorized use may result in legal action.

Warranties & Disclaimers

Our Warranties

We warrant that:

  • All work will be performed in a professional and workmanlike manner
  • We will use quality materials as specified in the contract
  • Our work will comply with applicable building codes and regulations
  • We will complete projects with reasonable care and skill

Warranty Period

Unless otherwise specified in your project contract, we provide a 12-month warranty on workmanship from the date of project completion. This warranty covers defects in our workmanship but does not cover normal wear and tear, damage from misuse, or modifications made by others.

Disclaimer of Other Warranties

Except as expressly stated above, our services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee uninterrupted or error-free service and are not liable for delays caused by circumstances beyond our reasonable control.

Limitation of Liability

To the fullest extent permitted by Pakistani law, Trivion Developments, its directors, employees, and agents shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Damages arising from third-party actions or materials
Delays or failures caused by force majeure events
Damages exceeding the total amount paid for the specific service

Our total liability for any claims arising from our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Trivion Developments and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

  • Your breach of these Terms and Conditions
  • Your violation of any law or the rights of a third party
  • Your use of our services in a manner not authorized by these Terms
  • Any inaccurate or misleading information you provide
  • Your failure to obtain necessary permits or approvals

Dispute Resolution & Governing Law

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Lahore, Pakistan.

Dispute Resolution Process

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or our services, the parties agree to the following resolution process:

Negotiation

Good faith negotiations between the parties for 30 days

Mediation

Mediation through a mutually agreed mediator if negotiations fail

Legal Action

Arbitration or legal proceedings in Lahore, Pakistan as a last resort

Termination

We reserve the right to terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

Project Cancellation

Either party may terminate a project contract with written notice. In case of termination:

  • Client shall pay for all work completed up to the termination date
  • Client shall reimburse all materials purchased for the project
  • A cancellation fee of 15% of the remaining contract value may apply

Changes to These Terms

We reserve the right to modify or replace these Terms and Conditions at any time at our sole discretion. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last Updated" date.

Your continued use of our services after any modifications indicates your acceptance of the updated Terms. It is your responsibility to review these Terms periodically. If you do not agree to the modified terms, you must discontinue use of our services.
